Village Market and tribe hotel causing more damage as the petition case continues.

KENYA (Commonwealth Union)_ Kenya is known to have high end luxury vacation needs if one knows where to look and what to ask for. Now here we see the very much up market mall that is named the Village market and on the same strip is the Tribe Hotel. Both these lands belong to The Koinange family.

It also looks like the Koinange family is falling in to two sectors where the split of the property is concerned. A few days ago, there was a petition filed by the administration of the estate on the eviction of both properties dependent on which land belonged to whom.

The family has been split over the decision as the petition was filed without the knowledge of all the administrators. Isabella Wanjiku, who is the daughter of the former provincial council commissioner Charles Karuga Koinange, noted that even though they have an ongoing dispute with Greenhill’s Investment who own the mall, the case itself was filed without her knowledge.

The case was filed almost a year ago and the court battle has been going on since. The case was filed by Ashford Mugwuku who was instructed to do so by Peter Mbiyu Koinange, who is one of the administrators of the estate. The other 3 administrators are Ms. Wanjiku and her nephew Samuel Karuga.

Ms. Wanjiku has instructed her lawyer Philip Murgor to get the case struck out by the courts since the matter was filed without any kind of consultation. She even stated that this petition was filed in the courts without the knowledge or the consent of the co-administrator. Philip agreed that there may be a chance that the courts won’t take this any further.

Mr. Mbiyu states that the family need to be given ownership of the property that sits on this land although it belongs to Greenhill investment. He states that the land was acquired fraudulently and there fore legally he has claim over the land that he is a co-administrator for.
