Europe UK (Commonwealth Union) – British Prime Minister Rishi Sunak is likely to face pressure from different sides as he attempts to bring in measures to curb the illegal boat crossings. The ‘Stop the Boats’ bill is set to block illegal migrants from seeking asylum in the UK. The processing of migrants will result in genuine refugees sent to a 3rd safe country such as Rwanda and those who do not qualify as refugees will be sent back to their country of origin. The PM is likely to face pressure from around 60 backbenchers within his party who have threatened to block the PMs bill unless he takes even stronger measures against illegal migration and have even brought up the possibility of withdrawing from the European Convention of Human Rights (ECHR) as they have been an obstacle according to the MPs by previous attempted measures to stop illegal migration.
A UK withdrawal from European Court of Human Rights (ECtHR), would require a formal process of withdrawal from the European Convention on Human Rights (ECHR).
The ECHR is a separate treaty from the European Union and the UK’s exit from the EU does not affect its status as a signatory to the ECHR. The European Court of Human Rights (ECtHR) is an international court that is responsible for interpreting and enforcing the European Convention on Human Rights (ECHR). The UK is a signatory to the ECHR and has accepted the jurisdiction of the ECtHR.
Decisions made by the ECtHR are binding on the UK, but the UK government has the ability to appeal to the Grand Chamber of the ECtHR if it disagrees with a decision. The UK government is also obligated to take steps to implement the ECtHR’s decisions. Questions regarding sovereignty have often been raised by those opposed to ECtHR role in the UK, as the UK remains a signatory to the ECHR and subject to the jurisdiction of the ECtHR.
