Parliament approves  the industrial and medical growing of cannabis

Africa (Commonwealth Union) _ In a notable achievement, Ghana’s parliament has recently enacted the Narcotics Control Commission Bill, 2023, thereby giving the Ministry of Interior the power to grant licenses for cannabis cultivation. This groundbreaking legislation marks a significant turning point and paves the way for a range of valuable applications of the versatile plant.

The passing of the Narcotics Control Commission Bill acknowledges the evolving global perspective on cannabis and the growing recognition of its potential benefits. With the authority to issue licenses for cultivation, the Ministry of Interior can regulate and oversee the production of cannabis within Ghana. This move not only establishes a legal framework but also opens up new avenues for economic growth and development.

The passage of this legislation comes after the Supreme Court’s intervention, which declared section 43 of the previous law as unconstitutional, causing obstacles in the legislative process.

Previously, section 43 of Act 1019 authorized the Minister, upon the recommendation of the Commission, to grant licenses for cannabis cultivation, commonly known as “wee” in Ghana. However, this provision has been removed due to its unconstitutional nature.

On July 12, 2023, Parliament deliberated on the Narcotics Control Commission (Amendment) Bill, 2023, which includes a single clause that empowers the Minister to grant licenses for cannabis cultivation within the country once passed.

With the enactment of this law, Ghana takes a significant step towards harnessing the potential benefits of cannabis cultivation. The government aims to explore its industrial potential by allowing controlled cultivation of cannabis with limited THC content for fiber and seed production. Additionally, the regulated exploration and utilization of cannabis for its medicinal properties can now be further pursued.

This legislative achievement is expected to pave the way for the development of a well-regulated cannabis industry in Ghana, ensuring cultivation and usage adhere to strict guidelines and quality standards.
