Global (Commonwealth Union) _ The former president of South Korea, Yoon Suk Yeol, has been rearrested following allegations that have been linked to his controversial martial law declaration attempt in December last year. The decision was issued by Seoul’s Central District Court on Wednesday and was based on concerns regarding Yoon’s ability to tamper with evidence while he awaited the trial.
Initially impeached in April 2024, Yoon made history as the first South Korean president to face arrest while in office. His actions in the latter part of 2023, such as the alleged sidelining of cabinet members as well as the deployment of military drones near North Korea, led to widespread crisis, both politically and legally.
Currently facing charges of insurrection and abuse of authority over the martial law declaration, Yoon, if he is found guilty of the former, would have to face life in prison or the death penalty. The prosecuting team also argued that Yoon’s martial law declaration lacked the required legal and democratic basis.
A special counsel team that had been appointed by the current president, Lee Jae-myung, laid out five crucial charges against Yoon during a hearing on Wednesday that went on for seven hours. According to reports by local media outlets, the charges faced by Yoon included bypassing essential cabinet procedures, along with the deliberate provocation of military tension in order to justify the emergency declaration of martial law.
Although the former president attended the hearing alongside his legal team, he did not, however, appear in court the following day for the insurrection trial. He is now allegedly being held at the Seoul Detention Centre, where he previously spent up to 52 days, prior to his release earlier this year on technical grounds.
According to an official at the detention centre, Yoon is to be held in a solitary holding cell of 10 square metres with no air conditioning, despite the ongoing heatwaves that South Korea is experiencing. Media reports allege that the former president is to have a small electric fan along with a foldable mattress on the floor.
National Assembly speaker Woo Won-shik has declared that the detention is expected to assist in uncovering the true nature of the martial law crisis and in restoring democracy.
