In India, commercial surrogacy is prohibited. In addition, there are certain requirements for couples and surrogate mothers who choose surrogacy. Among the couple, the man must be between the ages of 26 and 55 and the woman between the ages of 25 and 50. The couple must be Indian citizens, have been married for at least five years, and have no biological, adopted, or surrogate babies.

After the birth of Nayanthara and Vignesh Shivan’s twin kids, it was questioned if the couple had followed the correct protocol, which demands a couple to be married for five years prior to choosing surrogacy. Ma Subramanian stated that an inquiry will be made through the Director of Medical Service as to whether the surrogacy guidelines were adhered to properly.
