Europe UK (Commonwealth Union) – New regulations have been introduced to classify nitrous oxide as a Class C substance, a move aimed at curbing its misuse. The possession of nitrous oxide, colloquially known as ‘laughing gas,’ will become illegal by year-end, with potential penalties of up to two years in prison, as part of a zero-tolerance approach to combat anti-social behavior.

This prohibition was pledged as a crucial component of the government’s Anti-Social Behaviour Action Plan. The Home Secretary has called upon law enforcement agencies to take a more stringent stance against public drug consumption, which has been a source of disruption in communities.

On September 5th, secondary legislation was enacted to reclassify nitrous oxide as a Class C substance under the Misuse of Drugs Act 1971. These updated measures are slated to take effect by the end of the current year.

Nitrous oxide ranks as the third most commonly used drug among individuals aged 16 to 24 in England. The police have documented connections between its use and instances of anti-social conduct, such as intimidating gatherings on main streets and in children’s parks, as well as the presence of discarded nitrous oxide canisters in public spaces. Prolonged and heavy use of nitrous oxide can result in vitamin B12 deficiency, a type of anemia, and in more severe cases, nerve damage or paralysis.

Individuals found in unlawful possession of nitrous oxide could face penalties of up to two years in prison or an unlimited fine, while those involved in its distribution or production may be subject to penalties of up to 14 years. Exceptions will be made for legitimate uses of nitrous oxide, such as in medical or catering industries.

Crime and Policing Minister Chris Philp says “We cannot allow young people to think there are no consequences to misusing drugs.”

“There is no question that abusing laughing gas is dangerous to people’s health and it is paramount we take decisive action before the situation gets worse.”
