Kerala High Court: Vice-Chancellors can continue until Governor makes a decision

INDIA (Commonwealth Union) – It looks like the Kerala High Court is finally coming through with relief for the problems that were being faced by the eight Vice – Chancellors of the Universities. There was noticed issued to the chancellors of these universities where they will be removed from the governing positions after scrutinizing the problem.

The issue was that the governing body had to come up with a solution as to who will step up until then. Choosing a complete outsider to be the governor takes a lot of time and the process is long, grueling and time consuming. Even if they were to have an acting governor from someone already on the governing body, they would have to be careful because of the court order.

For this reason, the universities went back to the court system and asked for a solution and stated that they could have the vice chancellors as the acting chancellors until all the problems were solved and the process of finding a new chancellor could begin. The issue was that the chancellor who was removed from the post had then asked the vice chancellors to also vacate their posts.

The Kerala High court was not going to let this happen and they came to a unanimous decision under the Justice Devan Ramachandran to grant the relief of the vice chancellor being allowed to stay on in service until they are lawfully removed from their post. This means that the governor himself would have to issue them notice and then in that time period the vice chancellors would have to leave their job capacity.

Justice Ramachandran of course stated that this was the only solution where the entire university was not disrupted and claims he will stand by his decision.
