Netflix Faces Lawsuit Over Alleged Illegal Data Collection from Children

Ken Paxton, attorney general in Texas, has filed a lawsuit against Netflix. His accusations claim that the streaming company had been collecting data without consent, especially from children and other users. It further goes on to explain that Netflix has been secretly tracking viewers’ habits, preferences, devices and online activity when it had been depicting a picture of itself as a highly privacy-friendly platform. The officials in Texas have argued that the company has violated laws on consumer protection by gathering this information and allegedly sharing it with advertising and data technology companies.

The accusations have mentioned that “dark patterns” have been used by Netflix for design features that are intended to keep people watching for longer periods of time than were previously intended. As an example, it is highlighted in the lawsuit that it is the autoplay feature, which is intended to automatically start another episode or movie after one finishes. Claims have been made by the Texas officials that these features can be extremely harmful for children who are still learning resilience and are vulnerable to social media constantly surrounding them in the modern day. The accusations explain clearly that the feature encourages excessive screen time for children, in which Netflix gains more user data that can be collected.

Attorney General Paxton stated that Netflix had created a “surveillance program” designed to profit from user information. The lawsuit further claims that Netflix misled customers for years by saying it did not collect or sell personal data, despite allegedly building detailed profiles of its users’ viewing behaviours. Texas is pursuing civil penalties, modifications to Netflix’s platform, and the elimination of potentially illegally collected data.

Denying the accusations strongly, the multi-billion-dollar company has stated that the lawsuit is carried out through inaccurate information and lacks merit. The company has confidently laid out that the privacy laws have been carried out thoroughly and has provided an option for parental controls and safety tools. However, this lawsuit has grown to spark controversy regarding the addictive nature of technology and how children’s online privacy is at risk. It is now a growing concern that tech companies use personal data for profit.
