Africa (Commonwealth Union) _ In Yenagoa, Nigeria, on September 19, a Nigerian court granted bail to 69 individuals who were arrested the previous month for their alleged involvement in a same-sex wedding, which is prohibited in the country. Nigeria, like several African regions, views homosexuality as culturally and religiously unacceptable. In 2014, despite international backlash, the nation implemented anti-gay laws, reflecting a widespread stance against homosexuality in the country.

A court in Nigeria’s oil-rich Delta state ordered the release of detainees upon posting a 500,000 naira ($645) bail per person. The suspects, who didn’t personally appear in court, must regularly sign a register at the Warri town court until their next hearing. Ochuko Ohimor, their lawyer, confirmed this development. The detainees were granted bail in connection with their arrest for an alleged same-sex wedding, which is prohibited in Nigeria.

Ohimor explained, “They are to provide sureties, who will submit their particulars to the court. So, the 69 suspects have been granted bail and I am processing their paperwork.”

Although state prosecutors initially opposed the granting of bail, the court decided in Favor of releasing the suspects, reasoning that they were not charged with capital offenses. As of now, state prosecutors have not responded to requests for comments.

Nigeria’s anti-gay legislation, applicable in Africa’s most populous nation, stipulates severe penalties, including imprisonment for up to 14 years, for those found guilty. This legislation also prohibits same-sex marriages, engaging in same-sex relationships, and participating in gay rights organizations.
